E-Commerce Regulatory Compliance under the IT Act and Consumer Protection Laws in India

The E-Commerce Regulatory Framework in India

Operating an e-commerce platform in India requires complying with multiple laws, including the Consumer Protection Act, 2019, the IT Act, 2000, and FDI regulations.

1. Marketplace vs. Inventory E-Commerce Models

FDI policies distinguish between two types of e-commerce platforms:

  • Marketplace Model: The platform acts as a facilitator between third-party sellers and buyers. 100% FDI is permitted under the automatic route. The platform cannot influence product pricing or hold inventory.
  • Inventory Model: The platform owns and sells inventory directly to consumers. Foreign investment is **not permitted** in this model.

2. Consumer Protection (E-Commerce) Rules, 2020

E-commerce entities must comply with consumer protection regulations, which mandate:

  • Displaying the country of origin, seller details, return policies, and consumer grievance contact information.
  • Appointing a Grievance Officer who must acknowledge complaints within 48 hours and resolve them within one month.
