Family Law: Resolving Matrimonial and Custody Disputes in India

Matrimonial matters in India are governed by personal laws (such as the Hindu Marriage Act, 1955, and the Special Marriage Act, 1954) administered through specialized Family Courts.

1. Mutual Consent Divorce

Under Section 13B of the Hindu Marriage Act, couples can file a joint petition for divorce by mutual consent if they have lived separately for at least one year and have mutually agreed to dissolve the marriage. The process requires a statutory six-month waiting period, which can be waived by the court in exceptional circumstances.

2. Child Custody and Maintenance

In custody disputes, the welfare of the child is the primary consideration for the court. The court can grant joint custody, sole custody, or visitation rights depending on the childтАЩs age and the parentsтАЩ financial stability. Maintenance (alimony) is determined based on the income and assets of both spouses.
